These Terms of Use (“Terms”) govern your access to and use of the Goodhaus website and services (the “Service”). By accessing the Service or submitting any information, you agree to these Terms. If you do not agree, do not use the Service. These Terms contain a binding arbitration provision and a class-action waiver (Section 11) that affect your legal rights.
Goodhaus is a free lead-generation and matching service only. We connect users with independent, third-party home-improvement contractors and service providers (“Service Providers”). We are not a contractor and do not perform, supervise, manage, or guarantee any work. We are not a party to any agreement, quote, communication, or transaction between you and any Service Provider. We are merely a venue that facilitates an introduction.
We do not endorse, recommend, employ, control, or act as an agent for any Service Provider. We do not vet, screen, background-check, or verify the licensing or insurance of Service Providers, and nothing on the Service is a guarantee of a Service Provider’s licensing, insurance, bonding, qualifications, background, workmanship, pricing, honesty, safety, or fitness. You are solely responsible for independently evaluating, verifying, selecting, contracting with, and supervising any Service Provider, including confirming licenses, insurance, references, permits, and reviews before hiring or making any payment.
All dealings, communications, contracts, payments, and disputes are solely between you and the Service Provider. Goodhaus is not responsible or liable for anything arising from those dealings, including the quality, timing, legality, or outcome of any work; property damage; personal injury; cost overruns; delays; or any act or omission of any Service Provider.
You understand that the purpose of the Service is to collect your information and share and/or sell it to one or more Service Providers and marketing partners, who may then contact you. By submitting a request, you expressly consent to be contacted by Goodhaus, Service Providers, and their agents/partners at the phone number and email you provide — including via autodialer, artificial or prerecorded voice, and SMS/MMS text messages — regarding your project and related offers, even if your number is listed on any Do-Not-Call registry. You represent and warrant that: you are at least 18 years old; the information you submit is accurate; you are the owner of the property or are authorized to request services for it; and your use complies with all applicable laws.
You agree not to submit false information, use the Service for unlawful purposes, scrape or misuse data, interfere with the Service, or infringe others’ rights.
The Service, including its content, design, logos, and trademarks, is owned by Goodhaus or its licensors and is protected by law. You may not copy, reproduce, or create derivative works without permission.
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that any Service Provider will meet your needs. We make no warranty regarding any Service Provider or any work they perform.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, Goodhaus, ITS AFFILIATES, AND THEIR OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR PROPERTY, ARISING OUT OF OR RELATING TO THE SERVICE OR ANY SERVICE PROVIDER, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. Goodhaus’S TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (USD $100). Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
You agree to indemnify, defend, and hold harmless Goodhaus and its affiliates and their personnel from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Service, your submissions, your dealings with any Service Provider, or your violation of these Terms or any law.
Because we are only an introduction service, you release Goodhaus from any and all claims, demands, and damages of every kind arising out of or connected with any dispute between you and a Service Provider or the acts, omissions, work, or conduct of any Service Provider.
Any dispute arising out of or relating to these Terms or the Service will be resolved by binding individual arbitration, and not in court, except that either party may bring an individual claim in small-claims court. You and Goodhaus waive any right to a jury trial and to participate in a class, collective, or representative action. Arbitration will be administered under the rules of a recognized arbitration provider, in [STATE], under the Federal Arbitration Act. You may opt out of arbitration within 30 days of first accepting these Terms by submitting our online form with your name and a statement that you opt out.
